Doctors' insurance rates stay stable
For the second year in a row, Illinois' largest insurer of physicians has announced its base premium rates will not go up -- the result, many say, of the state's stabilized legal environment brought by a medical malpractice law in 2005 that capped awards for "pain and suffering." Medical malpractice caps are unconstitutional, suit claims
A lawsuit filed Monday alleges that recent legislation capping medical malpractice awards is unconstitutional. The law, which took effect Aug. 25, 2005, limits awards for pain, suffering and disability to $500,000 per doctor and $1 million per hospital. There are no limits for medical expenses.
