N.J. Appeals Court Lets $70.8 Million Med-Mal Verdict Stand
A New Jersey appeals court has refused to disturb a $70.8 million medical malpractice award to the family of a brain-damaged infant, ruling it was not excessive in light of the injuries. In response to the Daily Herald's recent editorial, I believe Gov. Jim Doyle should sign the legislation that reinstates a cap on non-economic damage awards in medical malpractice cases. The Daily Herald's statement that the proposed $750,000 cap was taken "out of thin air" is in error.
